§ 1 General provisions
The shop functions according to the guidelines detailed in these Terms and Conditions.
The Terms and Conditions outline the requirements for forming and ending Product Sales Agreements, the complaint process, the types and scope of electronic services offered by the Store, the rules for providing these services, and the terms for entering and terminating electronic service agreements.
Every user who engages with the Store's Electronic Services must adhere to the provisions of these Terms and Conditions.
§ 2 Definitions provided in the Terms and Conditions
ORDER FORM - a web form that enables the placement of an Order.
CUSTOMER - an individual who intends to or has already entered into a Sales Agreement with the Seller.
CONSUMER - an individual engaging in a legal transaction with the entrepreneur that is not directly connected to their business or professional activity.
PRODUCT - a tangible item available in the Store, which is the subject of the Sales Agreement between the Customer and the Seller.
REGULATIONS - these Terms and Conditions of the Store.
SHOP - the Service Provider's online store
SALES AGREEMENT - an agreement for the sale of Products concluded between the Customer and the Seller through the Store.
ORDER - the Customer's declaration of intent, constituting an offer to enter into a Product Sales Agreement with the Seller.
§ 3 Information About Products and Their Ordering
The Store offers Products for sale online.
The Products available in the Store are new, free from physical and legal defects, and have been legally introduced to the Polish market.
The information on the Store's website does not constitute a legal offer. By placing an Order, the Customer submits an offer to purchase a specific Product under the terms outlined in its description.
The Product price displayed on the Store's website is in the local currency and includes all components. The price does not cover delivery costs.
Orders can be placed on the website using the Order Form, available 24 hours a day, year-round.
To place an Order in the Store, the Customer must read and accept the Regulations at the time of ordering.
§ 4 Conclusion of the Sales Agreement
To conclude a Sales Agreement, the Customer must place an Order in advance using the method provided by the Seller, in accordance with § 3 points 5 and 6 of the Regulations.
After placing the Order, the Seller promptly confirms its receipt.
The confirmation of Order acceptance, as referred to in point 2 of this paragraph, binds the Customer to their Order. This confirmation is sent via email.
The confirmation of receipt of the Order includes:
a confirmation of all essential elements of the Order,
a contract withdrawal form,
these Terms and Conditions, which include information on the right to withdraw from the contract.
Upon the Customer's receipt of the email referred to in point 4 of this paragraph, a Sales Agreement is formed between the Customer and the Seller.
Each Sales Agreement will be confirmed with a proof of purchase, which will be included with the Product.
§ 5 Methods of Payment
The Seller offers the following payment methods:
payment by traditional bank transfer to the Seller's account,
payment through an electronic payment system.
For payments made through an electronic payment system, the Customer must complete the payment before the Order is processed. The electronic payment system allows payments by credit card or quick transfers from selected Polish banks.
The Customer must pay the price stated in the Sales Agreement within 3 working days from the date of its conclusion, unless otherwise specified in the Sales Agreement.
The Product will be shipped only after payment has been received.
§ 6 Cost, Date, and Methods of Product Delivery
The delivery costs, which are covered by the Customer, are determined during the Order placement process.
The Product delivery date includes both the time required to prepare the Product and the time taken by the carrier to deliver it:
the time required to complete the Products is 3 working days,
the delivery of Products by the carrier takes place within the period declared by them, typically 3 working days from the moment of shipment (delivery occurs only on working days, excluding Saturdays, Sundays, and holidays).
§ 7 Product Complaint
Warranty Claim.
The basis and scope of the Seller's liability towards the Customer who is a Consumer under the warranty for physical and legal defects are specified in the Civil Code of April 23, 1964,
Notifications of defects regarding the Product and the submission of a relevant request can be made via email to the following address:
In the above message, whether in written or electronic form, please provide as much information and detail regarding the complaint as possible, including the type and date of the irregularity and your contact details. This information will greatly facilitate and expedite the Seller's review of the complaint,
The Seller will respond to the Customer's request promptly, no later than 14 days from the date the complaint is filed,
If a Consumer Customer submits a complaint and it is not addressed within 14 days, it is considered accepted. For a valid complaint from a Consumer Customer, the Seller will cover the costs of collection, delivery, and replacement of the Product with a defect-free one,
The response to the complaint will be provided on paper or another durable medium, such as an email or text message.
§ 8 Right of Withdrawal from the Agreement
Subject to point 10 of this paragraph, a Customer who is also a Consumer and has concluded a distance contract may withdraw from it without giving any reason by submitting a relevant statement within 14 days.
In the event of withdrawal from the contract, the Sales Agreement is considered void, and the Consumer is required to return the Product to the Seller or hand it over to a person authorized by the Seller without delay, but no later than 14 days from the date of withdrawal, unless the Seller has proposed to collect the Product themselves. To meet the deadline, it is sufficient to send the Product back before the period expires.
The Consumer is responsible for any decrease in the value of the Product resulting from its use beyond what is necessary to establish its nature, characteristics, and functioning. To determine these aspects, the Consumer should handle and inspect the Product only as they would in a physical store.
Subject to points 6 and 8 of this paragraph, the Seller will refund the value of the Product along with the delivery costs using the same payment method used by the Consumer, unless the Consumer has expressly agreed to a different method of return that does not incur any costs for them. Subject to point 7 of this paragraph, the refund will be processed immediately, and no later than 14 days from the Seller's receipt of the withdrawal statement from the Sales Agreement.
If the Consumer has selected a delivery method other than the Store's cheapest standard delivery option, the Seller is not obligated to reimburse the additional costs incurred.
If the Seller has not offered to collect the Product from the Consumer themselves, they may withhold reimbursement of payments received from the Consumer until they receive the item back or are provided with proof of its return, whichever occurs first.
The Consumer withdrawing from the Sales Agreement, in accordance with point 1 of this paragraph, is only responsible for the costs of returning the Product to the Seller.
The fourteen-day withdrawal period for the Consumer begins on the date the Consumer takes possession of the Product, or, in the case of a service, from the date the contract is concluded.
The right to withdraw from a distance contract is not available to the Consumer in cases where the Sales Agreement concerns, among others, a non-prefabricated item made according to the Consumer's specifications or designed to meet their individual needs,
Both the Seller and the Customer have the right to withdraw from the Sales Agreement if the other party fails to fulfill its obligation within a strictly specified period.
§ 9 Type and Scope of Electronic Services
The Service Provider offers the use of the Electronic Service through the Store, enabling the conclusion of Product Sales Agreements.
The provision of Electronic Services to Service Recipients in the Store is governed by the conditions set out in the Regulations.
The Service Provider has the right to place advertising content on the Store's website. This content is an integral part of the Store and the materials presented within it.
§ 10 Conditions for the Provision and Conclusion of Contracts for Electronic Services
The provision of the Electronic Service specified in § 9 point 1 of the Regulations by the Service Provider is free of charge.
The contract for the provision of Electronic Services, which allows for the submission of Orders in the Store, is concluded for a specific period and terminates when the Order is placed or ceases to be placed by the Service Recipient.
Technical requirements necessary for cooperation with the ICT system used by the Service Provider:
a computer (or mobile device) with Internet access,
access to email,
a web browser,
enabling Cookies and JavaScript in the web browser.
The Service Recipient is required to use the Store in a manner consistent with the law and decency, respecting the personal rights and intellectual property rights of third parties.
The Service Recipient must enter data that is accurate and factual.
The Service Recipient is prohibited from providing illegal content.
§ 11 Complaints Related to the Provision of Electronic Services
Complaints related to the provision of Electronic Services via the Store may be submitted by the Service Recipient via email
In the email, please provide as much information and context as possible regarding the subject of the complaint, including the type and date of the irregularity and your contact details. This information will greatly facilitate and expedite the Service Provider's handling of the complaint.
The Service Provider will consider the complaint promptly, but no later than 14 days from the date of notification.
The Service Provider's response to the complaint will be sent to the Customer's email address provided in the complaint or by another method specified by the Customer.
